Poseidon Marine™ WARRANTY POLICY

All products sold by Bulgaria Marine Parts LTD. must be installed and used by competent personnel under their exclusive responsibility. Bulgaria Marine Parts LTD. shall not be responsible for the consequences of the faulty or improper installation of any item that does not include installation solutions. The fitter will be responsible for checking that the manufacturer recommendations have been followed correctly in terms of compatible uses. Articles sold by Bulgaria Marine Parts LTD. are covered by legal warranty of conformity, in accordance with Royal Legislative Decree 1/2007, of 16 November, approving the recast text of the general law on consumer and user protection. Bulgaria Marine Parts LTD. distribute the products only to professionals and never to privates of final clients. The cost of installing the part would never be included in the price for which reason, Bulgaria Marine Parts LTD. would never be responsible for its installation. Articles sold by Bulgaria Marine Parts LTD. are covered by warranty for manufacturing defects for a limited period of time that may vary between 2 years and 3 months, depending on the product, application and type of boat it is installed on (7th/6th/5th list), except for the articles considered consumable, light bulbs, electrical products, batteries and others that are not covered at all. For information on the exact warranty period of an article, please contact the Sales Department. In the case of damage caused during shipping, article 366 of the Code of Commerce will apply. The article says: “Claims to the delivery company may be made within 24 hours from receiving the goods. Once this term has elapsed, or the freight costs have been paid, claims to the delivery company with regard to the condition of the goods can no longer be made.” The goods that Bulgaria Marine Parts LTD. sends every day to its customers are examined before being packed to ensure their perfect integrity and avoid damage during shipping. Remember that it is essential to check the goods in the presence of the dispatcher. If the package is damaged, the dispatcher’s delivery note must mention what type (CONFORMING GOODS, UNLESS INSPECTED), and must be signed by you and by the dispatcher. If you receive damaged goods for these reasons you must notify both the dispatcher and Bulgaria Marine Parts LTD. to be able to make the claim to the relevant delivery company.

WARRANTY CLAIMS

Warranties are always subject to Bulgaria Marine Parts LTD. Technical Department’s assessment. The assessment will be carried out on Bulgaria Marine Parts LTD.’s premises or, if necessary, by the article’s manufacturer. In both cases, the article must be physically on Bulgaria Marine Parts LTD.’s premises in Sofia. Assessment time will not exceed 30 calendar days from receiving the article. WARRANTY EXCLUSIONS

Bulgaria Marine Parts LTD shall not be responsible for product faults in the following cases: • Normal wear and tear of a product. Installation faults or improper use. • Installation of an article not designed for the model in question. • Damage due to external causes (accidents, lightening, power surges...) • Defects and consequences of transport. • Alterations to installations or to boats intended for competitions. If the warranty is refused, the customer may retrieve the faulty article by contacting Bulgaria Marine Parts LTD via email and requesting that the article is returned to them within 7 calendar days from the day the warranty was refused. Bulgaria Marine Parts LTD does not apply the warranties offered from time to time by manufacturers.

RETURN POLICY

As mentioned in the conditions, certain products are excluded from return eligibility. While some of them are defined pretty clearly, others need further clarification.

Custom goods: A product that differs from the one advertised. This can be an engine repair kit with undersize bearings or oversize pistons.

Specially ordered items: These items are sold on demand and are ordered from a different supply network. On the footer of the product, it will be clearly mentioned that they do not meet the criteria of return.

Original parts: Genuinely branded products (Volvo Penta, Yanmar, MerCruiser, Yamaha, Suzuki, Tohatsu, J/E OMC BRP, Mercury, Sherwood, Johnson Pump SPX, Jabsco). These products are not a replacement, therefore you should verify them against your requirements. 

Exception applies which is thoroughly explained in the WARRANTY POLICY above as well as in the DAMAGED DURING TRANSPORT section below.

FORMAL REQUIREMENTS

Goods returned must be accounted for in a delivery note. Neither the goods nor the packaging must be damaged. We specifically clarify that the sales box is not a shipping box. If you want to ship a return in the sales box, kindly use a foil or a bag to wrap the product's box. Goods that do not meet any of these requirements will not be accepted under any circumstance.

PRODUCTS

All products, unless specified individually, are replacement parts build to substitute the original ones.

TERMS

Goods must be returned maximum within 15 calendar days from the date the goods were shipped from our premises. The deadline to return goods will be maximum 15 calendar days from the date the return preauthorisation number is received.

CONDITIONS

Under no circumstances will Bulgaria Marine Parts LTD accept the following articles:

  • Footwear.
  • Electrical goods.
  • Custom-made goods.
  • Anodes, anchors, chains, hoses.
  • Obsolete or discontinued articles.
  • Thrusters, pneumatics, paddle surfing boards and Parsun engines.
  • Oils, paints, greases, liquids, including all cleaning and maintenance products in general.
  • Specially ordered items
  • Original products.

DAMAGE DURING TRANSPORT

Article 366 of the Code of Commerce will apply. The article says: “Claims to the delivery company may be made within 24 hours from receiving the goods. All previously authorised returned goods must be sent to Bulgaria Marine Parts LTD visibly specifying the return number.

CREDITING

Bulgaria Marine Parts LTD will credit 80% of the amount originally charged of all returned goods (which comply with each and every formal requirement, terms and conditions). 20% is retained to cover the cost of returning the goods (handling, packaging, quality control...). This 20% will described in short as RESTOCKING FEE(R.F.) and will not be withheld for

i) Damaged during transport items

ii) Defective upon arrival items

iii) Wrong references shipped from us (different from what you ordered)

Buyer pays return shipping cost unless the return reason is one of the above (i,ii,iii).

Lastly, all descriptions on our website is a basic reference, however many engines have exclusions. We recognise responsibility only in the event a prior communication has happened and customer has provided engine details (Serial number, model etc) via email/order comment/SMS etc.
